Privacy Policy & SMS TERMS AND CONDITIONS

 

Overview

At Guidelines (“we,” “us,” “our”), we value your privacy and are committed to protecting your personal information. This Privacy Policy and SMS Terms and Conditions explains how we collect, use, disclose, and safeguard your information including your name, email, address, and when you opt-in to receive SMS/text messages from us.

 

Personal data that we process

The following table explains the types of data we collect and the legal basis, under current data protection legislation, on which this data is processed.

Inquiring about our organization and its work Name, email, message Legitimate interests – it is necessary for us to read and store your message so that we can respond in the way that you would expect.
Subscribing to email updates about our work Name, email Consent – you have given your active consent.
Making a donation Name, email, address, payment information, phone number Legitimate interests – this information is necessary for us to fulfill your intention of donating money and your expectation of receiving a confirmation message. Phone Number: Required to send you SMS/text messages if you opt-in.
Website functionality Website activity collected through cookies Legitimate interests – it is necessary for us to store a small amount of information, usually through cookies, to deliver functionality that you would expect, such as remembering the contents of your order before you have fully completed the process.

How we use your data

We will only use your data in a manner that is appropriate considering the basis on which that data was collected, as set out in the table at the top of this policy.

For example, we may use your personal information to:

  • reply to inquiries you send to us;
  • handle donations or other transactions that you initiate;
  • where you have specifically agreed to this, send you marketing communications by email relating to our work which we think may be of interest to you.

 

When we share your data

We will only pass your data to third parties in the following circumstances:

  • you have provided your explicit consent for us to pass data to a named third party;
  • we are using a third party purely for the purposes of processing data on our behalf and we have in place a data processing agreement with that third party that fulfils our legal obligations in relation to the use of third party data processors; or
  • we are required by law to share your data.

In addition, we will only pass data to third parties outside of the EU where appropriate safeguards are in place as defined by Article 46 of the General Data Protection Regulation.

 

How long we keep your data

We take the principles of data minimization and removal seriously and have internal policies in place to ensure that we only ever ask for the minimum amount of data for the associated purpose and delete that data promptly once it is no longer required. You may opt out of receiving SMS/text messages from us at any time by: texting “STOP” to the number from which you received the message; or contact us at [contact email/phone number].

 

Rights you have over your data

You have a range of rights over your data, which include the following:

  • Where data processing is based on consent, you may revoke this consent at any time and we will make it as easy as possible for you to do this (for example by putting ‘unsubscribe’ links at the bottom of all our marketing emails).
  • You have the right to ask for rectification and/or deletion of your information.
  • You have the right of access to your information.
  • You have the right to lodge a complaint with the Information Commissioner if you feel your rights have been infringed.

Please note that relying on some of these rights, such as the right to deleting your data, will make it impossible for us to continue to deliver some services to you. However, where possible we will always try to allow the maximum access to your rights while continuing to deliver as many services to you as possible.

 

Cookies & usage tracking

A cookie is a small file of letters and numbers that is downloaded on to your computer when you visit a website. Cookies are used by many websites and can do a number of things, eg remembering your preferences, recording what you have put in your shopping basket, and counting the number of people looking at a website.

Where cookies are used to collect personal data, we list these purposes in section 1 above, along with other personal data that we collect. However, we also use some cookies that do not collect personal information but that do help us collect anonymous information about how people use our website. We use Google Analytics for this purpose.  Google Analytics generates statistical and other information about website usage by means of cookies, which are stored on users’ computers. The information collected by Google Analytics about usage of our website is not personally identifiable. Modifications

We may modify this Privacy Policy from time to time and will publish the most current version on our website. If a modification meaningfully reduces your rights, we’ll notify people whose personal data we hold and is affected.

SMS/MMS Consent and Terms

By providing your mobile phone number to Guidelines upon making a donation, you can consent to receive periodic SMS or MMS messages from us. These messages may include important updates, information, and other communications related to the organization. You may also use this as a means to communicate with us.

 

Providing Your Telephone Number and Notification Obligations

You affirm that the mobile number you have provided to us is accurate and current. You represent that you are the authorized subscriber or owner of any telephone number you provide. If there are any changes to your contact information, including changes to your telephone numbers, you agree to notify us immediately by sending an email to [email protected] prior to the effect of the change. 

 

Consent to Receive Automated Communications

By voluntarily providing your telephone number(s), you explicitly consent to receive recurring automated and not automated text messages from Guidelines regarding our services, and your relationship with us. You acknowledge that consent to receive these messages is not a condition of purchase. Standard message and data rates may apply. 

 

Opt-Out Instructions

To unsubscribe from our SMS/MMS messages at any time, you can text STOP in response to any message you receive from us. Additionally, you can send an email to [email protected] specifying that you wish to opt out of text messages. You agree to receive a final message confirming your opt-out. You may also text HELP for help or information.

 

Carrier Participation

Participating carriers in the United States include AT&T, T-Mobile®, Verizon Wireless, Sprint, Boost, U.S. Cellular®, MetroPCS®, InterOp, Cellcom, C Spire Wireless, Cricket, Virgin Mobile, among others. Not all carriers may support our SMS/MMS service.
T-Mobile is not liable for delayed or undelivered messages.

 

Data Collection and Use

In connection with this SMS service, we may collect your mobile phone number, carrier’s name, and the date, time, and content of your messages among other information you provide. This information may be used to contact you and to deliver the services you
have requested from us.

 

Service Modifications and Termination

By subscribing or using the service, you acknowledge our right to modify or discontinue the service, with or without notice, at any time.

 

Indemnification

You agree to indemnify Guidelines against any claims, including privacy, tort, or others, arising from your voluntary provision of a telephone number not owned by you, failure to notify us of changes in your telephone number, or related to the Federal Telephone Consumer Protection Act or state law equivalents. You agree to defend and hold us harmless from any claims, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from such issues.

 

Participation Requirements

By participating in this Service, you affirm that you are at least eighteen (18) years of age, possess a wireless device capable of two-way messaging, are a customer of a participating wireless carrier, and have a text messaging service. Compatibility of cell phone models with the service, text messaging capabilities, and service availability may vary by carrier.

 

Miscellaneous

You warrant and represent that you possess all necessary rights, powers, and authority to agree to these terms and perform your obligations hereunder, and that doing so does not conflict with any other agreement to which you are bound. If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these terms shall otherwise remain in full force and effect.
